After completing the procedure

The legal consequences of the regional review committee’s findings

  1. The doctor complied with the due care criteria in section 2 of the Act
    A positive decision from the review committee means that in administering euthanasia or assisting in suicide the doctor acted with all due care. The grounds for immunity from prosecution laid down in article 293, paragraph 2 and article 294, paragraph 2 of the Criminal Code apply and the doctor is not criminally liable. This is a final decision. The case is then closed.
  2. The doctor did not comply with the due care criteria in section 2 of the Act
    A negative decision from the review committee means that the doctor did not act with due care in administering euthanasia or assisting in suicide. The committee notifies the Board of Procurators General and the relevant health inspector of its findings. These bodies then decide on the basis of their own competence and responsibility whether further steps under either the criminal law or disciplinary law need to be taken against the doctor.
